Terms of use

These terms of use set out the terms and conditions under which Trackisy makes its GPS fleet tracking platform (web and mobile) available to its customers, as well as the rights and obligations of the parties.

Access to the service requires creating an account and, for GPS tracking, connecting compatible devices installed on the fleet's vehicles. Devices are installed by the customer or by an installation partner.

The account holder is responsible for the confidentiality of its credentials and for all actions performed from its account. Access for multiple users within the same company can be managed by role, depending on the subscribed plan.

Trackisy offers two commercial plans, whose pricing terms are specified in the quote or purchase order: the "Platform" plan, for customers who already own their GPS devices and for our reseller partners, billed per device on a tiered rate; and the "All-in-one" plan, which includes supplying, installing and providing the SIM card for the devices, billed per vehicle on a tiered rate.

Unless otherwise agreed in the order form, all Trackisy plans are billed annually in advance, excluding tax. Renewal of the "All-in-one" plan from the second year onward is billed at a rate equal to 60% of the first-year rate.

Devices supplied under the "All-in-one" plan carry a one-year hardware warranty from the date of installation. After this period, any device replacement is billed at 200 MAD. Damage resulting from vandalism or an accident is excluded from this warranty.

The "All-in-one" plan includes one vehicle transfer (uninstalling and reinstalling a device on another of the customer's vehicles) per year. Any additional transfer is billed at 250 MAD.

The user agrees to:

• Use the service in accordance with its intended purpose and applicable regulations,
• Inform its drivers and employees about the use of a GPS tracking device on the fleet's vehicles, as required by applicable regulations,
• Not misuse the service for surveillance purposes that do not comply with applicable regulations,
• Keep its account information up to date.

Trackisy uses reasonable means to ensure the availability and continuity of the service. The service may be subject to temporary interruptions for maintenance, updates, or in case of force majeure, without any specific availability rate being contractually guaranteed outside of a dedicated service level agreement (SLA), where applicable. no contractual SLA on standard plans; a specific SLA is defined in the Enterprise quote

The Trackisy platform, its code, interfaces, brand and content are the exclusive property of Geopilot or its licensors. Nothing in these terms grants the user any ownership right over the service. Fleet data generated through use of the service (positions, trips, reports) remains the property of the customer.

Trackisy uses reasonable means to provide a reliable service, but cannot guarantee the complete absence of errors, interruptions or inaccuracies, in particular those related to the network coverage of the GPS devices installed on the vehicles. For the "Platform" plan, Trackisy is neither the manufacturer nor the installer of the customer's own devices and cannot be held responsible for a hardware malfunction attributable to a third-party device or its installation. The customer remains solely responsible for its use of the data produced by the service and for complying with the regulations applicable to its business.

The remote engine cut-off feature is made available to the customer as a fleet management tool. Its use is the customer's sole responsibility; the customer agrees to trigger it only through an authorized user of its account, under conditions that safeguard the safety of people and property. Trackisy cannot be held responsible for any damage resulting from use of this feature by the customer or by a user it has authorized.

As Trackisy plans are billed annually in advance, the subscription continues until the end of the current annual period, unless terminated as set out in the applicable commercial contract or order form. 30 days' written notice before the annual renewal date

These terms of use are governed by Moroccan law. Casablanca Commercial Court

Trackisy may modify these terms of use at any time to reflect changes to the service or to applicable regulations. The version in force is the one published on this page, together with its last-updated date.
