Terms of use

These terms of use govern access to and use of the Trackisy platform by its customers.

Purpose

These terms of use set out the terms and conditions under which Trackisy makes its GPS fleet tracking platform (web and mobile) available to its customers, as well as the rights and obligations of the parties.

Access to the service

Access to the service requires creating an account and, for GPS tracking, connecting compatible devices installed on the fleet's vehicles. Devices are installed by the customer or by an installation partner.

User accounts

The account holder is responsible for the confidentiality of its credentials and for all actions performed from its account. Access for multiple users within the same company can be managed by role, depending on the subscribed plan.

User obligations

The user agrees to:

  • Use the service in accordance with its intended purpose and applicable regulations,
  • Inform its drivers and employees about the use of a GPS tracking device on the fleet's vehicles, as required by applicable regulations,
  • Not misuse the service for surveillance purposes that do not comply with applicable regulations,
  • Keep its account information up to date.

Service availability

Trackisy uses reasonable means to ensure the availability and continuity of the service. The service may be subject to temporary interruptions for maintenance, updates, or in case of force majeure, without any specific availability rate being contractually guaranteed outside of a dedicated service level agreement (SLA), where applicable. Intellectual property

The Trackisy platform, its code, interfaces, brand and content are the exclusive property of Trackisy or its licensors. Nothing in these terms grants the user any ownership right over the service. Fleet data generated through use of the service (positions, trips, reports) remains the property of the customer.

Liability

Trackisy uses reasonable means to provide a reliable service, but cannot guarantee the complete absence of errors, interruptions or inaccuracies, in particular those related to the network coverage of the GPS devices installed on the vehicles. Trackisy is neither the manufacturer nor the installer of the GPS devices and cannot be held responsible for a hardware malfunction attributable to a third-party device. The customer remains solely responsible for its use of the data produced by the service and for complying with the regulations applicable to its business.

Termination

Either party may terminate access to the service under the conditions set out in the applicable commercial contract or order form. [[TO BE COMPLETED: contractual notice period and termination terms]]

Governing law and jurisdiction

Changes to these terms

Trackisy may modify these terms of use at any time to reflect changes to the service or to applicable regulations. The version in force is the one published on this page, together with its last-updated date.
